Products, parts, systems and services of Black Spark Performance are intended solely for motorsport, race and track use on closed grounds, including circuits, track days and private tests.

They are not intended, approved or guaranteed for use on public roads, nor for vehicles that must meet type approval, RDW requirements, MOT/inspection, emissions, noise limits or similar rules, unless otherwise agreed in writing.

Any use, fitting or application on a vehicle that participates in public road traffic is entirely voluntary and fully at the risk of the customer or user.

Black Spark Performance is not responsible for the legal permissibility of the vehicle or modification, nor for inspection, registration, insurance, noise, emissions, safety, fines, impoundment, damage, injury or third-party claims related thereto.

To the extent permitted by law, Black Spark Performance disclaims all liability for consequences of (unauthorised) road use.

Information on this website or in quotes, correspondence or conversations is not legal or inspection advice and does not promise that a product or modification is legal, permissible, insurable or inspection-proof for road use in the Netherlands or elsewhere.

The customer must verify, with expert help if desired, whether the intended use is allowed.

Products must be fitted, adjusted and maintained professionally. Incorrect fitting, misuse, overload, poor maintenance, third-party modifications or use outside intended race or track conditions may lead to damage, failure or injury.

The customer is responsible for expert fitting, correct use, periodic checks and safe application.

Motorsport and track use involve inherent risks, including material damage, injury and in extreme cases death. By submitting a request, placing an order or using products, the customer accepts these risks.

To the extent permitted by law, Black Spark Performance is not liable for indirect or consequential damage, lost income, downtime, reputational harm, damage from road use or other use outside the intended purpose, damage from incorrect fitting or maintenance, nor for fines, administrative measures, insurance cover or inspection refusal.

Where liability nevertheless exists, it is – to the extent permitted by law – limited to the amount paid for the relevant order or products, or to the amount paid out by the liability insurer in that case if higher.

Liability for intent or wilful recklessness by Black Spark Performance, and liability that may not be excluded or limited by mandatory law, remains unaffected.

Any warranties apply only within the agreed race or track purpose and the written terms. Use outside that purpose, incorrect fitting, misuse or third-party modifications may void the warranty.

Mandatory consumer rights remain unaffected where the law so requires.

The customer indemnifies Black Spark Performance, its staff and suppliers against claims, fines, costs (including reasonable legal costs) and third-party damage arising from public road use, use contrary to law or regulation, incorrect fitting or use, or breach of this disclaimer, insofar as indemnity is legally permitted.

By submitting a request, accepting a quote, placing an order or purchasing products or services, the customer declares to have read and accepted this disclaimer.

Dutch law applies to this disclaimer, without prejudice to mandatory provisions that may apply to consumers. Disputes are submitted to the competent Dutch court, unless mandatory law provides otherwise.
